The Central Govt. has finally decided to implement the resolution that in the event of filing charge sheet against IAS and IPS officers they will be dismissed from services subject to the effect that if they get acquittal in the cases they will be taken back in the services and their pay, seniority and other benefits will be protected.
It means after dismissal they will not be given any suspension allowance. Since they will not remain in the services of the govt.they will be free lancers and can do any work they like and can also join any firm or industrial house. They will also not accountable to government. In such case the decision of the government should be welcomed.
Secondly there is vast difference between dismissal and termination. The dismissal means the officer is barred from getting any job in the government even a job on daily wages. Does govt. wishes to do so?
The procedure laid down is that a committee of 3 Retired Supreme Court Judges will consider about dismissal of such officer and shall give opinion to Central Vigilance Commission (CVC). If report is not sent in time fixed by the rules that is within 3 weeks the CVC may write to the said committee to send it and failing witch suitable action will be taken against them! Is CVC is bound by the opinion of the committee. It may tern down the opinion. Will the retd. Judges tolerate it?
Why judges of any rank in the judicial hierarchy should be involve them for no reason. Neither it is befitting for the govt. and not for judges. The judges should also abstain from acting as committee members and save themselves from any such temptation. A man is a social animal and is generally prone to corruption and encroachments on others property of any nature and a judge is also a human being! It is therefore always said that a judge should live like hermit and work like a horse. It is not said about any other service of any nature.
Another thing is the rule should equally be made applicable to elective members of any body as the politicians and such bureaucrats have honour among thieves.
